Nexium Lawsuit Settlements

There are no Nexium settlements for kidney injuries because the cases are still being litigated. The judicial panel consolidated the cases into MDL 2789 and appointed Judge Clair C. Cecchi to lead the proceedings in a New Jersey court.

Some of the plaintiffs involved in past Nexium lawsuits are said to have settled cases out. If so, no settlement amounts were disclosed.

Ongoing Nexium Lawsuits

As of January 2023, more than 18,500 PPI lawsuits were on file, with 13,553 pending. These claims involve several manufacturers who make a class of drugs called proton pump inhibitors, or PPIs. The first bellwether trial involving Nexium was delayed in New Jersey from late 2022 to March 2023. Two other bellwether jury trials are set for April 2023 and May 2023.

PPIs are linked to kidney failure, bone fractures and liver damage. Many people who suffered from kidney damage or other health problems after taking Nexium filed legal claims against the drug’s manufacturer, AstraZeneca. Plaintiffs allege the companies knew about the risks associated with PPIs but failed to warn them, other patients and the medical community about the medication’s dangers.

Manufacturers disclosed routine side effects, such as headaches and dry mouth, but didn’t reveal more serious side effects such as kidney and liver damage. Some legal claims allege that AstraZeneca knew about these health risks for at least 10 years but failed to disclose them and other Nexium side effects.

Past Nexium Lawsuits

PPI manufacturers have faced previous lawsuits, but most stemmed from allegations of malpractice. Nexium launched in 2001 as a replacement for Prilosec, and AstraZeneca was accused of using false advertisement. It was alleged that the company misrepresented Nexium as a better alternative to other PPIs as it asked for consumers to shy away from cheaper alternative medications. The plaintiff sought restitution of all unlawful profits that AstraZeneca made, plus the cost of bringing the lawsuits.

In 2015, AstraZeneca paid the U.S. government $7.9 million to settle allegations that it participated in a kickback scheme. The company was accused of paying pharmacy benefit managers to retain Nexium as a “sole and exclusive” formulation, effectively narrowing or eliminating competing drugs. This not only limited the types of drugs that people could buy but also the prices they could pay.

Besides Nexium, AstraZeneca has dealt with other lawsuits. In one suit, the company paid a settlement of $520 million for off-label drug marketing.

Nexium lawsuits can take years to settle. AstraZeneca is a behemoth pharmaceutical company that brought in a record $44.3 billion in 2022 with $3.8 billion in reported operating profit. Like all Big Pharma firms, the company can afford to pay expensive legal fees to defend itself.

Plus, drug cases may need scientific evidence to prove that the drug caused the problem, a process that can delay litigation. AstraZeneca considers its Nexium litigation among its “more significant” ongoing legal issues and updates stockholders in its annual report and sometimes in quarterly 10K filings with the Securities and Exchange Commission.

In 2011, a woman filed a case against AstraZeneca for having bone fractures after taking Nexium. After a year, judges consolidated that case with more than 1,000 similar lawsuits.

In 2014, the judges closed the case in favor of AstraZeneca. That took about two to three years to settle. Many factors determine how fast a case settles. These include the strength and volume of evidence, complexity of the case and how hard (and how long) each side wants to fight.

Anyone who took Nexium either as a prescription medication or as an over-the-counter drug and developed a kidney problem may qualify to bring a case and get a Nexium settlement.
